AI Cold Calling for Real Estate: What Works and the Rules
AI cold calling for real estate explained: AI dialers vs AI voice agents, the FCC's 2024 ruling on AI voices, consent, Do Not Call and where AI calls fit.

"AI cold calling" gets used for very different things. For some teams it means a dialer that calls four numbers at once and connects a caller to whoever picks up. For others it means a voice agent that talks to the owner with no person on the line. The rules and the results are very different, so it is worth separating them.
This guide covers the main kinds of AI calling tools, the FCC's 2024 ruling, consent and Do Not Call, and where AI calls actually fit in a real estate desk.
Three kinds of AI calling
- AI dialers. A person still talks to the owner. The software dials several numbers in parallel, skips voicemail and dead lines, and connects your caller only when someone answers. It saves time between conversations.
- AI voice agents. Software talks to the owner with a generated voice: it introduces itself, answers questions, asks qualifying questions and books a time. No person is on the line.
- AI call assistants. Tools that transcribe, summarize and score calls made by people, or coach the caller in real time.
The second kind is where the legal picture changes.
The FCC's 2024 ruling on AI voices
On February 8, 2024, the FCC unanimously adopted a declaratory ruling (FCC 24-17, CG Docket No. 23-362) confirming that AI-generated voices are "artificial" voices under the Telephone Consumer Protection Act. Law firms that reviewed it, including Mayer Brown and Cooley, read it as clarifying that existing TCPA rules cover AI rather than creating new ones.
What that means in practice:
- A call that uses an AI-generated voice is treated like a prerecorded call.
- A call to a cell phone needs the prior express consent of the person called, unless an exemption applies.
- A telemarketing call, to a cell phone or a home line, generally needs prior express written consent.
- The call must identify the business at the start and give a phone number, and telemarketing calls must offer an automated way to opt out.
For a real estate investor, an AI voice agent placing cold calls to owners who never gave consent is the dangerous case: calls to cell phones without consent violate the TCPA, and each call can carry statutory damages. An AI voice answering an owner who called you is a much easier case, because the TCPA's consent rules govern calls you place, not calls you answer.
Consent, Do Not Call and calling hours
These rules apply to cold calls whether or not AI is involved:
- National Do Not Call Registry. Scrub your lists before calling, and keep scrubbing on the schedule the rules require.
- Is an offer to buy a "solicitation"? The Do Not Call and calling-hour rules cover telephone solicitations: calls that encourage someone to buy, rent or invest in property, goods or services. Several federal courts, including in Arizona and California, have held that calls offering to buy a home are not solicitations. At least one court in New York held that a home-buying company's calls could be marketing. A call that pitches a service, such as listing the house with an agent, is a solicitation. The law is unsettled, so most investors scrub anyway.
- Internal do-not-call list. When an owner asks you to stop, stop, on every number and channel.
- Calling hours. The federal telemarketing window is 8 a.m. to 9 p.m. in the owner's time zone. Some states set narrower windows.
- State laws. Several states, including Florida and Oklahoma, have their own telemarketing laws with stricter rules and private lawsuits.
- Opt-outs. Since April 11, 2025, FCC rules let people revoke consent by any reasonable means, such as saying "stop calling" or replying "stop," and callers must honor it within 10 business days. Honor it at once.
- Dialers that call several numbers at once. For telemarketing calls, the FCC caps abandoned calls at 3% of answered calls over 30 days and requires an identifying message when no caller is free.
- Recording and transcription. Some states, including California, Florida, Illinois, Pennsylvania and Washington, require every party's consent to record a call. AI that records or transcribes calls should announce it at the start.
- Caller ID. Carriers verify and label calls. Numbers that dial too much get marked as spam, and answer rates drop.
This is general information as of October 2026, not legal advice, and the rules change often. Have a lawyer who knows the TCPA and your state's law review your calling before you start.
Where AI calls fit
| Use | Fit | Why |
|---|---|---|
| AI answering inbound calls | Strong | The owner started the conversation; AI never misses a call |
| AI callbacks to owners who asked to be called | Good, with consent recorded | The owner asked for the call |
| AI dialer with a human caller | Good, within abandonment limits | A person talks; AI cuts the dead time |
| AI summaries and call scoring | Good, with recording consent | Helps coaching; recording laws apply |
| AI voice agent cold calling owners without consent | Avoid | Calls to cell phones without prior express consent violate the TCPA |
Calls work best next to text and email
Many owners will not answer an unknown number but will reply to a short text or an email. A desk that reaches owners on all three channels, and keeps one thread per owner across them, gets more conversations than one that only dials. See AI texting for real estate for the texting side, which has its own registration and consent rules.
How Skipset handles calls
Skipset reaches owners by call, text and email, qualifies them on price, condition, timeline and motivation, and books the appointment on your calendar. Every call and message is disclosed and logged, and an opt-out is honored on every channel. Your acquisitions rep takes the appointment. See outreach and AI for real estate investors.

Questions
- Is AI cold calling legal for real estate?
- It depends on the tool. On February 8, 2024, the FCC ruled that AI-generated voices are artificial voices under the TCPA, so calls that use them need the prior express consent of the person called unless an exemption applies. A person calling with an AI dialer or AI coaching tool is a different case, but Do Not Call, calling hours, dialer abandonment limits, call recording laws and state telemarketing laws can still apply. Get advice from a TCPA lawyer.
- What is the difference between an AI dialer and an AI voice agent?
- An AI dialer helps a human caller: it dials several numbers, skips voicemails and connects your caller when someone answers. An AI voice agent talks to the owner itself with a generated voice. The second one falls under the FCC's ruling on artificial voices.
- Can AI answer inbound seller calls?
- Yes, and inbound is one of the safest places to use it. An owner calling you back has started the conversation. Many investor CRMs now offer AI that answers, asks qualifying questions and transcribes the call. Disclose that the caller is talking to AI and let them reach a person.
- Do AI calls need to be disclosed?
- The TCPA rules for artificial and prerecorded voice calls include identifying who is calling, and the FCC's 2024 ruling confirms those rules cover AI-generated voices. Beyond the legal minimum, telling the owner they are talking to AI is simply good practice.
